Terms of Service

1.Accounts & eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. When you create an account, you agree to provide accurate information and to keep it up to date. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly at the address in Section 16 if you suspect unauthorized use.

2.Organizations & roles

FleetPRO is organized around workspaces (each, an “Organization”). The person who creates an Organization becomes its administrator and is responsible for that Organization’s account, its subscription, and the conduct of the employees, crew, and clients they invite into it. Administrators may invite, manage, and remove other users, and may access and control the data within their Organization. If you are invited into an Organization by an administrator, your use of the Service is also subject to that administrator’s policies and decisions, including their decision to suspend or remove your access.

3.Acceptable use

You agree not to, and not to allow anyone to:

• use the Service for any unlawful, fraudulent, infringing, or abusive purpose;
• upload content you do not have the right to upload, or that violates the privacy or intellectual-property rights of others;
• attempt to gain unauthorized access to the Service, other Organizations’ data, or our systems;
• probe, scan, reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying structure of the Service, or copy, reproduce, modify, or create derivative works of any part of the Service — including its source code, software, user interface, visual design, layout, or features — except to the limited extent this restriction is prohibited by applicable law;
• use any robot, spider, scraper, crawler, headless browser, or other automated means to access, monitor, index, extract, harvest, or copy any data, content, or material from the Service, without our prior written consent;
• access or use the Service (or permit anyone to) to build, develop, train, market, or improve a competing or substantially similar product or service, to copy or benchmark its features, design, or workflows, or for any competitive-analysis purpose;
• introduce malware, interfere with or disrupt the Service, or place an unreasonable load on our infrastructure;
• resell, rent, lease, sublicense, distribute, or otherwise commercially exploit the Service except as expressly permitted in writing; or
• use the Service to send unsolicited communications (spam) or to harass any person.

4.Your content & data

You and your Organization retain all rights to the data, photos, notes, documents, and other content you submit to the Service (“Your Content”). You grant us a limited, non-exclusive license to host, store, process, transmit, and display Your Content solely to operate, secure, and improve the Service and to provide it to the users within your Organization. You are responsible for the accuracy and legality of Your Content, including obtaining any consents needed to record and store information about your clients, crew, and their vehicles. You can export your data at any time using the in-app export tools, and you can request deletion as described in our Privacy Policy.

5.Subscriptions & billing

FleetPRO offers paid subscription plans (currently Starter, Pro, and Business) billed on a monthly or annual basis, as well as a Free plan. Paid plans renew automatically at the end of each billing period unless canceled before the renewal date. Fees are charged through our third-party payment processor and, except where required by law or expressly stated, are non-refundable. You authorize us and our payment processor to charge the payment method on file for all applicable fees and taxes. We may change plan prices or features on prospective notice; changes take effect at your next renewal. Subscriptions are purchased through our website, not through in-app purchase. Cancellation takes effect at the end of the current billing period, and you retain access to paid features until then.

6.Free plans & trials

We may offer a Free plan or promotional trial with limited features, usage limits, or duration. We may modify or discontinue free offerings at any time. Feature availability on each plan is described in the app and may change.

7.Third-party services

The Service relies on third-party providers for hosting, authentication, storage, email, push notifications, mapping, and payments. The Service may also let you connect your own third-party tools (for example, a payment link). We are not responsible for third-party services, and your use of them is governed by their terms. A current list of the providers we use to process data appears in our Privacy Policy.

8.Intellectual property

The Service, including its software, design, logos, and the name “FleetPRO,” is owned by Flow Pressure Washing LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. We reserve all rights not expressly granted. You may not use our marks without our prior written permission. Any feedback you provide may be used by us without obligation to you.

9.Privacy

Our Privacy Policy explains what information we collect, how we use it, and the choices you have. By using the Service, you agree to the practices described there.

10.Suspension & termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ends. We will make Your Content available for export for a reasonable period after termination unless prohibited by law, after which it may be deleted. Sections that by their nature should survive termination (including Sections 4, 8, 11–14, and 16) will survive.

11.Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA, LOCATION, OR DOCUMENT FEATURE WILL BE ACCURATE OR FIT FOR A PARTICULAR PURPOSE. Features such as geofenced clock-in, geocoding, and electronic-signature documents are provided as conveniences and should not be relied upon as the sole basis for legal, payroll, or compliance decisions.

12.Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOW PRESSURE WASHING LLC AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13.Indemnification

You agree to indemnify and hold harmless Flow Pressure Washing LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.

14.Governing law & disputes

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Georgia, and you consent to their jurisdiction. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

15.Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
